Executive exemption
Oklahoma’s minimum wage act exempts bona fide executive employees from its requirements; however, Oklahoma does not define the criteria for an employee to be deemed an executive employee. OK Statute 40-197.4(e)(8) Oklahoma may look to the standards set forth by the federal Fair Labor Standards Act regarding executive employees for guidance.
Administrative exemption

Outside salesman exemption

Computer employee exemption
Oklahoma’s minimum wage act does exempt computer systems analysts, computer programmers, software engineers, or other similarly skilled workers from its requirements.
Other minimum wage and overtime exemptions
Oklahoma’s minimum wage act exempts the following additional employee from its requirements:
- individuals working on a farm for another person and who works in connection with cultivating soil or raising or harvesting agricultural commodities, including raising, shearing, feeding caring for, training, and managing livestock, bees, poultry, and furbearing animals and wildlife, or working in connection with the operating, managing, conserving, improving, or maintaining a farm and its tools and equipment;
- individuals working in domestic service in or about a private home;
- individuals working for the Unites States government;
- individuals working as volunteers for a charitable, religious, or other nonprofit organization;
- individuals working as newspaper vendors or carriers;
- individuals working for a a carrier subject to regulation by Par I of the Interstate Commerce Act;
- individuals working as part-time employees (less than 25 hours per week) not on permanent status;
- individuals who are less than 18 years old and are not high school graduates or graduates of vocational training programs;
- individuals who are less than 22 years of age and who are students regularly enrolled in a high school, college, university, or vocational training program;
- individuals working in feedstores operated primarily for the benefit and use of farmers and ranchers;
- individuals working as reserve force deputy sheriffs.
