On May 22, 2018, Governor Malloy signed House Bill 5386. The new law modifies the state’s current pay equity and fairness law. The new changes prohibit employers from inquiring about prospective employees’ wage and salary history unless otherwise required to do so by state or federal law. Employes may inquire about prospective employees’ prior compensation structure (salary, commission, etc.), but cannot inquire about the value of the individual elements of the structure.
