Nebraska Minimum Wage and Overtime Exemptions




Executive exemption

Nebraska law exempts bona fide executive employees from its minimum wage requirements; however, it does not define the criteria for an employee to be deemed an executive employee. NE Statute 48-1202(3)(f) The standards set forth by the federal Fair Labor Standards Act regarding executive employees may provide reasonable guidance.



Administrative exemption

Nebraska law exempts bona fide administrative employees from its minimum wage requirements; however, it does not define the criteria for an employee to be deemed an administrative employee. NE Statute 48-1202(3)(f) The standards set forth by the federal Fair Labor Standards Act regarding administrative employees may provide reasonable guidance.




Professional exemption

Nebraska law exempts bona fide professional employees from its minimum wage requirements; however, it does not define the criteria for an employee to be deemed a professional employee. NE Statute 48-1202(3)(f) The standards set forth by the federal Fair Labor Standards Act regarding professional employees may provide reasonable guidance.



Outside salesman exemption

Nebraska’s law does not exempt outside salesmen from its minimum wage requirements.



Computer employee exemption

Nebraska’s law does not exempt computer systems analysts, computer programmers, software engineers, or other similarly skilled workers from its minimum wage requirements.



Other minimum wage and overtime exemptions

Nebraska law exempts the following individuals from its minimum wage requirements:

  • individuals employed in agriculture;
  • individuals employed as a baby sitter in or about a private home;
  • individuals employed by the United States, or by the state or any political subdivision thereof;
  • individuals engaged in the activities of an educational, charitable, religious, or nonprofit t organization when the employer-employee relationship does not in fact exist or when the services rendered to such organization are on a voluntary basis;
  • veterans in training under supervision of the United States Department of Veterans Affairs; or
  • children in the employment of their parent or parents in the employment of their child.
