Fringe Benefits: Vacations, Holidays, Sick Leave, Severance

The federal government does not have any laws governing an employers obligation to provide
fringe benefits, such as vacation benefits, holidays, sick leave (except as provided in the Family
and Medical Leave Act), and severance. DOL: Work Hours and Other Pay Issues.
Because federal law is silent, each state is responsible for its own laws regarding fringe
benefits. Although most states do not require employers to provided these fringe benefits,
many state have laws regarding an employer's obligation when they choose to provide them.
The fringe benefits laws of the states do vary, so be sure to educate yourself regarding the
fringe benefit laws of the states in which your employees work.
